www.OreoMiniDelivery.com (“Site”), home for Mel’s Mini-Mini Special Delivery (the “Promotion”). By accessing the Site and participating in the Promotion, you hereby agree to be bound by these Terms and Conditions.
If you do not agree to these Terms and Conditions, you may not participate in the Promotion. All decisions regarding the Site, the Promotion and these Terms and Conditions shall rest with Sponsor and shall be final and binding.
NO PURCHASE NECESSARY TO PARTICIPATE IN THE PROMOTION.
Promotion may only be entered in or from the 50 United States and the District of Columbia and entries originating from any other jurisdiction are not eligible for entry. Void where prohibited. This Promotion is governed exclusively by the laws of the United States. You are not authorized to participate in the Promotion if you are not located within the 50 United States and the District of Columbia.
1. How to Send a Delivery. Beginning at 9:00 AM Eastern Time (“ET”) on August 11, 2014, and continuing through 5:00 PM ET on August 22, 2014, Monday through Friday only (“Promotion Period”), you may go to the Site and send your favorite friend, family member, co-worker or whoever else you may choose an Oreo Mini Delivery (“Delivery”) by following the instructions on the Site, including by submitting your name, email address and mailing address and the name, email address and mailing address for your chosen recipient of the Delivery. Physical mailing addresses must be provided; P.O. boxes will not be accepted. To accompany the Delivery, you will be asked to provide a message (“Message”) by either (i) choosing from the selections on the Site or (ii) crafting your own Message. Your Message and any other information you submit shall be referred to collectively as your “Submission”. Recipients should expect to receive Deliveries within five (5) to nine (9) business days.
Only five hundred (500) Delivery requests will be accepted and only five hundred (500) Deliveries will be sent during each calendar day of the Promotion Period. Once there are five hundred (500) Submissions in a day, no more Deliveries will be sent and no further Deliveries can be requested during that day. Limit one (1) Submission per person, per email address, per day during the Promotion Period. Submissions must come from individuals only; requests from clubs or organizations will not be honored.
No automated entry devices and/or programs permitted. All entries become the sole and exclusive property of the Sponsor and receipt of entries will not be acknowledged or returned. Sponsor is not responsible for lost, late, illegible, stolen, incomplete, invalid, unintelligible, misdirected, postage-due, technically corrupted or garbled entries, which will be disqualified, or for problems of any kind whether mechanical, human or electronic. Only fully completed entry forms are eligible. Proof of submission will not be deemed to be proof of receipt by Sponsor. Requests that do not comply with these Terms and Conditions will not be honored. Fraudulent Submissions will be prosecuted to the fullest extent of the law. Deliveries are not redeemable in any manner other that as provided herein. Deliveries are non-transferable. No substitutions or cash redemptions. In the case of unavailability of any Delivery, Sponsor reserves the right to substitute a prize of equal or greater value.
2. Eligibility. Participation open only to legal residents of the 50 United States or the District of Columbia, who are 13 or older as of date of entry. Void outside the 50 United States and District of Columbia and where prohibited, taxed or restricted by law. Employees, officers and directors of Sponsor and its parent companies, subsidiaries, affiliates, partners, advertising and promotion agencies, manufacturers or distributors of Promotion materials and their immediate families (parents, children, siblings, spouse) or members of the same household (whether related or not) of such employees/officers/directors are not eligible to enter. Promotion may only be entered in or from the 50 United States and the District of Columbia, and entries originating from any other jurisdiction are not eligible for entry. All federal, state and local laws and regulations apply.
3. Submissions. By providing a Submission on the Site, you hereby grant Sponsor and its agents and licensees the right to use your name (first name or first name and last initial), hometown (city and state) and Submission for advertising and promotional purposes in any and all media. Submissions may be cut, edited, reformatted, rearranged, combined with other materials and/or otherwise modified, in Sponsor’s sole and absolute discretion. Without limiting the foregoing, Messages may be used in connection with artwork, illustrations or video created by or on behalf of Sponsor in connection with the Promotion. Additionally, Sponsor may create or cause to be created artwork inspired by your Message to accompany the Delivery.
You acknowledge that you, and not Sponsor or its agents, are fully responsible and fully liable for the Content of your Submissions. You agree that your Submission will not: (i) contain material that violates or infringes any rights of any other party, including but not limited to copyright, trademark, privacy, publicity or any other intellectual property or contractual rights; (ii) disparage Sponsor or any other person or party; (iii) contain material that is inappropriate, indecent, obscene, violent, hateful, tortious, defamatory, slanderous or libelous; (iv) contain material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation or age; or (v) contain material that is unlawful, in violation of or contrary to the laws or regulations in any state where the Submission is created (collectively, “Submission Guidelines”). Sponsor will not honor any Submission in violation of these Submission Guidelines.
4. Additional Content. In connection with the Promotion, you may submit additional content to Sponsor and its agents, including without limitation social media content that includes a hashtag provided by Sponsor. All such content provided by you in connection with the Promotion, whether submitted on the Site or elsewhere, shall be considered a Submission as that term is defined in these Terms and Conditions.
5. Conditions. By participating, you agree to release and hold harmless Sponsor, its advertising and promotion agencies and its parent companies, subsidiaries, affiliates, partners, representatives, agents, successors, assigns, employees, officers and directors, from any and all liability, for loss, harm, damage, injury, cost or expense whatsoever including without limitation, property damage, personal injury and/or death that may occur in connection with participation in the Promotion, or possession, acceptance and/or use or misuse of any Delivery or participation and any claims based on infringement of intellectual property or publicity rights, defamation, invasion of privacy and merchandise delivery.
6. Additional Terms. Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify, or suspend this Promotion should (in its sole discretion) a virus, bug, non-authorized human intervention or other cause beyond its control corrupt or affect the administration, security, or proper conduct of the Promotion. In case of dispute as to the identity of any participant, Submission will be declared made by the authorized account holder of the email address submitted at time of entry. “Authorized Account Holder” is defined as the natural person who is assigned an email address by an Internet access provider, online service provider, or other organization (e.g., business, educational, institution, etc.) responsible for assigning email addresses or the domain associated with the submitted email address. Sponsor, and its parent companies, subsidiaries, affiliates, partners and promotion and advertising agencies are not responsible for technical, hardware, software, telephone or other communications malfunctions, errors or failures of any kind, lost or unavailable network connections, Web site, Internet, or ISP availability, unauthorized human intervention, traffic congestion, incomplete or inaccurate capture of entry information (regardless of cause) or failed, incomplete, garbled, jumbled or delayed computer transmissions which may limit one's ability to enter the Promotion, including any injury or damage to participant’s or any other person’s computer relating to or resulting from participating in this Promotion or downloading any materials in this Promotion.
7. Sponsor’s Policies. The Site and the Promotion are also subject to Sponsor’s Terms of Use, located at http://brands.nabisco.com/MiscContent/Terms_of_use.aspx, and Sponsor’s Privacy Policy located at http://brands.nabisco.com/MiscContent/privacy_policy.aspx. By accessing the Site and participating in the Promotion, you acknowledge and agree that you have read and accepted these policies and agree that all personal data collected and used by or on behalf of Sponsor will be in accordance with these policies.
